Man Involved In Online Piracy Sentenced

SCOTT CARRERA, 33, of Darien, Illinois, has been sentenced by Chief United States District Judge Robert N. Chatigny in Hartford to three years of probation, the first six months of which CARRERA must spend in home confinement. Judge Chatigny also ordered CARRERA to pay a fine in the amount of $7500 and to perform 120 hours of community service. On May 7, 2007, CARRERA pleaded guilty to one count of conspiracy to commit criminal copyright infringement. This matter stems from a multinational software piracy investigation known as “Operation Higher Education.”

In pleading guilty, CARRERA admitted that, for more than two years, he was a participant in the “warez scene,” an underground online community consisting of individuals and organized groups who engage in the large scale reproduction, modification and distribution of copyrighted software over the Internet. CARRERA served as a site administrator for a warez site known as “HOP” and assisted in the administration of a second warez server identified as “TOP.” CARRERA assisted in the construction and maintenance of the “HOP” warez server, which contained a library of copyright-protected software, including movies, music, games and business software. As the site administrator, CARRERA allowed others to have access to the “HOP” server with the knowledge that they would upload new material to the server and download material for their own use. The “HOP” server contained more than 5000 pirated works, and CARRERA has admitted that he uploaded more than 180 and downloaded more than 2600 copyright-protected software titles.

“Operation Higher Education” is the largest component of the global law enforcement action known as “Operation Fastlink,” announced by the Department of Justice on April 22, 2004. Twelve nations participated in “Operation Higher Education.” The investigation yielded searches and seizures of more 70 high-level targets that were conducted in Belgium, Denmark, France, Germany, Hungary, Israel, the Netherlands, Singapore, Spain, Sweden, the United States, as well as Great Britain and Northern Ireland.

Guilty Plea, Steroids Over The Internet COREY L. STANFORD, JR., 31, of Austin, Texas, pleaded guilty before United States District Judge Janet C. Hall in Bridgeport to one count of distributing anabolic steroids. According to documents filed with the Court and statements made in court, STANFORD used the Internet, including the website sell.com, to communicate with individuals interested in buying steroids. STANFORD then sent the steroids to those individuals through the mail.

Botnet Herder Acidstorm Pleads Guilty In the first prosecution of its kind in the nation, a man who is well known to members of the “ botnet underground” pleaded guilty to federal charges related to his use of “ botnets” – armies of compromised computers – to steal the identities of victims throughout the country by extracting information from their personal computers and wiretapping their communications. John Schiefer, 26, of Los Angeles (90011), appeared before United States District Judge A. Howard Matz and pleaded guilty to accessing protected computers to conduct fraud, disclosing illegally intercepted electronic communications, wire fraud and bank fraud.
Diet Supplement Case, $120 Million To Be Paid The U.S. Court of Appeals for the Ninth Circuit has upheld a district court ruling requiring marketers of Seasilver, an alleged phony cure-all, to pay almost $120 million for failing to comply with an earlier order requiring them to pay $3 million in consumer redress. The decision, issued on April 10, 2008, affirmed a district court order requiring Jason and Bela Berkes, Seasilver, USA, Inc., and Americaloe, Inc., to pay almost $120 million under an agreement with the Federal Trade Commission. The March 2004 order barred them from making false or misleading claims and included a $120 million judgment that would be suspended if they paid $3 million within a specified time. The defendants did not meet the required payment terms, and in June 2006 a district court granted the Commission’s request to enforce the stipulated judgment. The defendants appealed the decision.
Identity Theft Charges, Guilty Plea On April 11, 2008, JASON DAVID LINGO, age 28, of Granite City, Illinois, pleaded guilty to a three count superseding indictment charging him with Possession of Unauthorized Access Devices, Mail Fraud, and Aggravated Identity Theft. At the time of the guilty plea, the prosecution detailed the evidence underlying the charges. On December 11, 2006, a librarian at the Collinsville Public Library became suspicious when LINGO was using a public computer terminal to purchase merchandise over the Internet. The librarian observed that LINGO was using different names and credit card numbers during the transactions. The librarian called the Collinsville Police Department, and LINGO was arrested shortly thereafter.
